MANILA, Philippines – The Supreme Court (SC) has barred the impeachment trial of Vice President Sara Duterte, ruling that the House’s articles of impeachment were unconstitutional.
In striking down articles, the High Court agreed with Duterte’s arguments that the impeachment was barred by the one-year bar rule, a constitutional protection that prohibits impeachment proceedings from being initiated against an impeachable official more than once in a year.
The 97-page decision, penned by Senior Associate Justice Marvic Leonen, also nulled the articles of impeachment on the grounds of due process. This was the main point of contention of the Dutertes’ allies, the second petitioners in the case.
