 81-year-old man freed after 6-month detention over mistaken identity

MANILA, Philippines — Prudencio Calubid Jr., 81, was detained for six months after the police insisted that he was the same “Prudencio Calubid” who’s wanted for murder and other crimes.

Calubid and his family argued that he was not the same suspect by providing documents to prove his identity. Despite this, he was still arrested, arraigned, and detained for six months in Manila City Jail.

Later, the Court of Appeals granted Calubid family’s writ of habeas corpus, paving the way for the man’s release.

The appellate court ruled that Calubid is a victim of mistaken identity and noted that the authorities did not exercise “due diligence” to check if he’s really the suspect intended to be arrested.
