The SEC has issued for public comment the draft 2026 ROP, which seeks to amend the 2016 edition by consolidating and simplifying the total number of rules to 17 across 86 sections, from the current 27 rules and 108 sections.

MANILA, Philippines — The Securities and Exchange Commission (SEC) is amending its Rules of Procedure (ROP) in line with its commitment to expedite the resolution of cases through streamlined administrative and adjudicative proceedings.

The SEC has issued for public comment the draft 2026 ROP, which seeks to amend the 2016 edition by consolidating and simplifying the total number of rules to 17 across 86 sections, from the current 27 rules and 108 sections.

According to the commission, the draft rules introduce 14 significant changes, including updates on jurisdiction, prioritization of electronic means of service and summons, and expanded coverage of enforcement powers to enhance procedural efficiency.

The proposed rules prioritize a shift to “electronic first” filing and service, institutionalizing electronic service and filing via email as the primary mode.

It also seeks to make use of the official email addresses designated by corporations under SEC Memorandum Circular 28, Series of 2020, for the service of SEC issuances, while expanding alternative modes of service, including publication on the commission’s website to ensure due process even when parties are elusive.
