MANILA, Philippines —  Rep. Paolo “Pulong” Duterte (Davao, 1st District) is facing a criminal complaint for alleged physical injuries and grave threats, the Office of the Prosecutor confirmed on Friday, May 2.

The complaint was filed by 37-year-old businessman Kristone Moreno, who accused Duterte of inflicting physical injuries and issuing grave threats during an incident on February 23 at a gastropub in Davao City, according to the investigation data form.

According to the Revised Penal Code, Article 282 or grave threats, involves warning or intimidating a person with harm to their life, honor, property or family. If found guilty, violators may face arresto mayor or imprisonment from one month and one day to six months, as well as a fine of up to P100,000.

The penalty for grave threats depends on whether the threat was carried out. If the threat involved a condition, like demanding money — and the offender followed through — the penalty is one degree lower than the punishment for the crime threatened. 

If the offender did not carry out the threat, the penalty is lowered by two degrees.

Meanwhile, Article 265 of the Revised Penal Code covers less serious physical injuries, such as those that prevent a person from working for at least 10 days or require medical treatment. The offense is also punishable by arresto mayor.

Caught on camera? The complaint may be linked to CCTV footage that quickly circulated online, showing Duterte seemingly raising his fist at another man and allegedly threatening him with a sharp weapon during their conversation. 

However, the video has yet to be verified by the Philippine National Police-Criminal Investigation and Detection Group (PNP-CIDG). 

The media has requested a statement from his office, but has yet to receive a response.

Duterte is one of the sons of former President Rodrigo Duterte and is currently facing complaints related to drug smuggling and graft concerning a P6.4 billion crystal meth shipment in Valenzuela City in 2017.

He was implicated by alleged customs "fixer" Mark Taguba, who claimed Duterte was a member of the "Davao Group," which allegedly dealt with shipment and customs issues. Taguba also said he and his family received death threats after making the accusations.
