MANILA, Philippines — Homeowners in Mandaluyong’s Addition Hills village have won in their appeal against the construction of a 15-story mixed-use building.
Aside from stopping the project, Wee Community Developers Inc. (WCDI) must pay at least P250,000 in attorney’s fees and costs of suit, the Human Settlements Adjudication Commission (HSAC) ruled.
In their appeal, the Addition Hills North Homeowners’ Association Inc. argued that the project violated the city’s zoning ordinance.
The HSAC declared as null and void the 2021 and 2022 resolutions of the city’s Local Zoning Board of Adjustment and Appeals, which allowed the project.
Sharing the homeowners’ position, the HSAC noted inconsistencies in the documents submitted by the property developer.
Six of eight alleged adjacent residents listed by the WCDI were found to be “mere employees” of the company’s partner Property Community of Friends Inc. or Profriends.
